Abandoned Vehicle FAQ

Can I just move the vehicle myself?
No. Moving or disposing of someone else's vehicle without following CRS 42-4-2103 creates liability for conversion — essentially unauthorized taking of property. Even after a court-ordered eviction, the vehicle must be towed by a licensed operator with proper notifications.
What if the tenant comes back for the car?
If towed, the tenant has 30 days to reclaim the vehicle from the tow yard by paying storage and towing fees. If they contact you directly, refer them to the tow yard. Do not allow them back on the property to retrieve the vehicle — that creates a safety and legal risk.
Who pays for the towing?
The property owner/landlord typically pays the initial tow fee. However, the tow yard recovers costs from the vehicle owner if they reclaim it. If unclaimed after 30 days, the vehicle is sold at auction and proceeds offset costs. Towing costs can also be deducted from the former tenant's security deposit as part of the eviction damages.
What if there are personal items inside the vehicle?
Personal items inside the vehicle stay with the vehicle — they go to the tow yard. The tenant can retrieve them during the 30-day reclaim period. Our crew does not enter or search abandoned vehicles. We document the exterior only.
What if there are multiple vehicles?
Each vehicle is documented and towed separately. Our towing partner can handle multiple vehicles in a single visit. Each vehicle gets its own compliance paperwork and separate 30-day reclaim period.
Does this apply to commercial evictions too?

How soon after eviction should the vehicle be towed?
As soon as possible after the writ is executed. The longer an abandoned vehicle sits on your property, the greater the liability — vandalism, fluid leaks, complaints from neighbors or HOAs. We recommend same-day towing coordinated with the cleanout.
